Governor Jerry Brown's office has officially responded to the panel of Federal Court justices rejecting a stay of the prisoner release ordered by them just days ago.

California Department of Corrections and Rehabilitation Assistant Secretary says "[The Department] will seek a stay from the U.S. Supreme Court. In the meantime, our appeal of the Three-Judge Court’s unprecedented order to release nearly 10,000 inmates by the end of this year is in progress, and we look forward to making our case to the Supreme Court justices that no further reduction in the prison population is needed."

The decision pushes the long-running court battle over unconstitutional conditions back to the U.S. Supreme Court. The administration has said it will seek a stay from Justice Anthony Kennedy, who oversees appeals from the Western states.
