As the San Francisco 49ers prepare to face the Indianapolis Colts this Sunday at Candlestick it looks like they'll have to deal with some off the field drama.

Comcast Sports Net's Matt Maiocco is reporting that third year outside linebacker Aldon Smith was arrested this morning for allegedly driving under the influence.

According to San Jose police, Smith was determined to be the driver in a single car accident into a tree. Nobody was hurt.

The San Jose Mercury News is reporting that Smith blew a .15 and had marijuana and pills in his vehicle at the time of his arrest.

"The 49ers organization is aware of the matter involving Aldon Smith. As we continue to gather information regarding this situation, we will have no further comment," a 49ers spokesman said in a statement.

Smith was previously arrested for DUI in January 2012 and is currently facing a lawsuit from a man who was shot at a party he hosted last year.
