California High Court Strikes Prop 49 from Ballot

The California Supreme Court has blocked placement of an advisory measure on the November ballot backed by Democrats.

By a 5-1 vote, the court on Monday ordered removal of Proposition 49, which would have asked voters if they want a federal constitutional amendment to overturn a U.S. Supreme Court ruling allowing unlimited corporate spending in elections.

The majority opinion said no harm will come from removing the non-binding measure while courts determine the measure's validity.

Writing separately, Justice Goodwin Liu agreed with the anti-tax group Howard Jarvis Taxpayers Association, which filed a lawsuit seeking its removal from the ballot.

The group argues that advisory measures are not a proper use of the ballot.

A divided appeals court had earlier ruled in favor of placing the proposition on the ballot.
