Is Sacramento's Panhandling Ban Unconstitutional?

Activists say Sacramento County's ordinance banning panhandling is unconstitutional -- now they're suing. 

They're hoping for a temporary injunction to suspend the ordinance that went into effect on June 13.

The Sacramento Homeless Organizing Committee says the new law violates the U.S. Constitution by allowing charities to collect money in public places but banning panhandlers from doing the same thing. 

The group is being represented by the American Civil Liberties Union of Northern California, who filed the lawsuit Thursday. 

Though activists may not be happy with the panhandling ban, those who spoke in favor of the ordinance back in May, say panhandling appears to be on the rise in certain parts of the county.
