The death of an inmate at Mule Creek Prison has gotten the attention of a federal judge. 

A hearing will be held looking into the death of Joseph Duran, a 35-year-old career criminal with a known history of mental disorders.

Duran, who breathed through a tube in his throat, had been pepper sprayed in the hours before his death. He was found unresponsive and near death in his cell. His death was ruled a suicide.

Following his death, a number of mistakes were made by prison staff, including not notifying the family of Duran's passing and cremating and scattering the ashes without consent.

The family is considering a suit against the Department of Corrections.
