There's another bump in the road for the Downtown Arena.

A preliminary ruling made Thursday by Judge Timothy Frawley could allow a lawsuit to move forward that challenges the city of Sacramento's agreement to build a new downtown sports arena.

Filed by three Sacramento residents against the city, the suit claims city leaders misrepresented the actual public subsidy for the arena.  

Frawley tentatively ruled the plaintiffs couldn't go forward with claims of fraud, but he is allowing the case to advance based on claims that components of the arena subsidy were illegal gifts of public funds.

A hearing is set for this morning.
