A Sacramento judge has tentatively denied a petitioner's motion for an injunction to halt construction of the new downtown arena.

Sacramento Superior Court Judge Timothy M. Frawley wrote the petitioner did not meet either of the two statute requirements for injunctive relief.

The two requirements are: that the project constitute an imminent threat to public health and safety or that the arena site contains unforeseen important Native American artifacts or unforeseen important historical archaeological or ecological values that would be adversely affected by the continued construction or operation of the downtown arena. 

Petitioners argued the statute is unconstitutional.

Construction on the project is scheduled to begin this summer.

A court hearing is set for Friday.
