Legislation Updates California Marriage Laws

California's family laws would reflect the legality of same-sex marriage under a bill headed to the governor's desk.

SB1306 passed the state Assembly on a 51-11 vote Monday.

The bill removes language from the family code that says marriage must be "between a man and a woman" and substitutes gender-neutral language throughout.

The bill also would remove limits on recognizing out-of-state same-sex marriages.

Democratic Sen. Mark Leno of San Francisco says his bill brings California law in line with court rulings allowing same-sex marriage to resume last year.

The California Supreme Court struck down language limiting marriage to heterosexuals in 2008.

Voters responded with Proposition 8 amending the state constitution, but a federal judge ruled it unconstitutional.

The U.S. Supreme Court upheld that ruling in 2013.
