A panel of the 9th Circuit Court of Appeals is blocking a federal judge's decision to overturn California's weapons ban.
The three-judge panel announced Monday it was putting a lower court's decision on hold. Judge Roger Benitez had ruled against the ban on June 4th, comparing an AR-15 semiautomatic to a Swiss Army knife, saying it was good for home and battle. Benitez had delayed his order taking effect for 30 days to give the state time to appeal his ruling.
According to theLos Angeles Times, an 11-judge 9th Circuit “en banc” panel is scheduled to hear arguments in that case Tuesday, and the ruling is likely to determine the future of the state’s assault weapons ban. A majority of the judges on the panel are Democratic appointees.
