New Lawsuit Challenges Emergency COVID-19 Workplace Regulations In CA

The National Federation of Independent Business is suing California's Division of Safety and Health, or Cal/OSHA, for allegedly ignoring legal procedures in creating new workplace rules during the pandemic. NFIB Spokesperson Karen Harned says small businesses owners will take on a significant financial burden if they are forced to comply.

California's Administrative Procedure Act requires giving notice and holding hearings that are open to the public. Under the new rules, employees are required to be excluded from the workplace for 14 days, even if they receive a negative test result.
