Appeals Court Rules Governor Newsom Emergency Powers Legal

A victory this morning for Governor Newsom - a California appeals court has ruled Governor Newsom's use of emergency powers during the pandemic were legal. Republican lawmakers said the Governor acted illegally when he issued an executive order allowing for a mail-in election. Republican Assemblyman James Gallagher says his fight is not over.

The appeals court found that Newsom’s order complied with the state’s Emergency Services Act, which gives the governor expanded powers in extreme circumstances. According to the Los Angeles Times, the ruling was a setback for Republican lawmakers who challenged the governor’s public health authority, and said they would ask the California Supreme Court to overturn the decision, handed down by a three-judge panel of the Sacramento-based 3rd District Court of Appeal.
