Sacramento prosecutors seeking the death penalty for man accused of breaking into a home, sexually assaulting and then killing the homeowner. Sacramento prosecutors are seeking a death penalty prosecution against Troy Davis, the man accused of breaking into a Land Park home, sexually assaulting and killing the homeowner, 61-year-old Kate Tibbitts last September. Davis, is currently held without bail at the Sacramento County Main Jail on murder, rape, arson, burglary and intentional maiming of animal charges.
Death penalty rulings are rare in the Sacramento court system, but have been made in cases involving especially heinous crimes, including the death penalty prosecution of Luis Bracamontes after he killed a Sacramento County sheriff’s deputy and a Placer County sheriff’s detective during a 2014 rampage. Governor Gavin Newsom has suspended use of the death penalty in the state, but prosecutors continue to pursue capital punishment cases in the event that his decision is overturned by a future administration. Davis' next appearance in Sacramento Superior Court is scheduled for June 10 of this year.
